The intended parents of baby Gabriel, who during the pregnancy asked the surrogate mother, McKenna West, to have an abortion after learning of the child’s serious heart condition, have finally authorized the heart surgery necessary to keep him alive. Gabriel underwent the first of three planned operations on Monday, August 17, to treat the hypoplastic left heart syndrome he suffers from and remains hospitalized while recovering from the procedure.
After West gave birth in Texas. The Alaska nurse had refused to comply with the abortion request from Nausheen Gilkar and Omar Ahmed and moved to Texas to continue the pregnancy and seek legal protection for the child. The day before the birth, Texas Attorney General Ken Paxton obtained a court order aimed at ensuring Gabriel received the necessary medical care after birth.
The parents finally authorized the surgery
The new situation was reflected in court documentation filed on August 17. Gilkar and Ahmed stated that, after consulting with doctors, they had decided to authorize the Norwood procedure, a complex open-heart surgery that constitutes the first phase of treatment for hypoplastic left heart syndrome.
Hours later, Lee Budner, the intended parents’ attorney, confirmed that the procedure had already been performed. According to his explanation, they gave consent for Gabriel to be operated on as soon as the hospital had availability.
«His condition continues to be critical and complex,» the attorney noted, adding that the infant is recovering under the care of his parents and the team of doctors and nurses attending him. The family has requested privacy during the recovery process.
The intended parents call the child Rumi and maintain that this is his legal name, while McKenna West called him Gabriel during the pregnancy. InfoVaticana has referred to the infant as baby Gabriel since the beginning of the case.
The first of three operations
Gabriel suffers from hypoplastic left heart syndrome, a serious congenital heart defect in which the left side of the heart does not develop properly. The condition was diagnosed when West was approximately 20 weeks pregnant.
Treatment usually requires three surgical interventions. The first, known as the Norwood procedure, must be performed shortly after birth. Two additional operations are planned during the first years of life.
It was precisely the diagnosis of this condition that triggered the conflict during the pregnancy. As InfoVaticana reported, the surrogacy contract included a clause allowing the intended parents to demand an abortion under certain circumstances. According to the court documentation known about the case, Gilkar and Ahmed requested that the pregnancy be terminated, but West ultimately refused.
The surrogate mother even offered to assume responsibility for the child or to waive any claim to him in exchange for the parents allowing the operations. Information published at the time by InfoVaticana indicated that the parents had stated that, after birth, they would authorize only «comfort care.»
The authorization of the surgery now known therefore represents a change from the position they had maintained until then.
Texas’s intervention before birth
The conflict reached the courts before Gabriel was born. Texas Attorney General Ken Paxton intervened on August 11 to request that the child be guaranteed necessary medical attention immediately after delivery.
The court established that, once born alive, Gabriel must receive the indicated medical care and prohibited obstructing necessary treatment or removing, discharging, or transferring the child while the court examined the case.
Gabriel was born the following day, August 12, approximately two and a half weeks before the scheduled delivery date.
After the birth, Gilkar and Ahmed obtained physical custody of the child and assumed decisions about his treatment within the limits established by the court rulings.
The legal dispute continues
The operation does not end the conflict between the surrogate mother and the intended parents. West intends to continue the legal dispute related to parental rights and custody, while the attorneys for Gilkar and Ahmed reject her claims.
The parents have also questioned some of the accusations made against them and the way the case has been presented publicly. Their defense maintains that the couple has acted in accordance with the medical advice received and has criticized the dispute for acquiring a political dimension.
The child whose life was at the center of the conflict during pregnancy has finally received the first of the three heart interventions he needs. He remains hospitalized and his situation continues to be critical and complex as he begins recovery from the surgery.
