On November 25, the Court of Justice of the European Union (CJEU) ordered Poland to recognize same-sex marriage. Polish legislation does not contemplate it, and the Polish Constitution explicitly establishes the State’s responsibility to protect marriage as a sexually differentiated union. When marriage is threatened, the family and society as a whole collapse. The Church has supported the EU project for decades; changing course would mean admitting its failure. The European project of Ursula von der Leyen, Frans Timmermans, and Javier Solana is not at all the same project as that of Konrad Adenauer, Alcide De Gasperi, and Jean Monnet, Catholic supporters of postwar European integration who attended Mass assiduously. We already know that the Catholic bishops of the European Union lack the courage to throw down the gauntlet and protect marriage and family. The future of Europe—and the integrity of its Christian witness—requires more than a procedural concern. It requires the courage to clearly express what is at stake.

And we end with an interesting seminar organized by sociologists of religion at the University of Padua, with a dynamic dialogue between historians, jurists, theologians, and sociologists, on the anniversary of the Declaration on Religious Freedom, Dignitatis Humanae. On one hand, the issue of the relationship between religions and States; on the other, the strength of the principle of freedom of conscience in the Catholic Church. Perhaps the most intense analysis in these 60 years has been dedicated to the institutional impact of that principle. But also its internal effect, that is, the consequences that freedom of conscience introduces in the way of thinking about doctrine and in the exercise of theological service. Dignitatis Humanae is the conciliar document that allows the Catholic Church to move from a society of honor to a society of dignity. Not only the doctrine, but also the believers themselves embrace freedom of conscience as a constitutive element of their faith. This also changes the way those who call themselves theologians can offer syntheses of wisdom and light to the lives of men and women.

If the provisions of the 1983 Code are examined, comparing them with those of the 1917 Code, it is observed with consternation that canon 752 imposes a limitation on the theologian’s freedom of research, which has increased rather than decreased. The due obedience extends to the entire magisterium (both irreformable and reformable), one wonders how it would have been possible, with these 1983 norms, to depart from the positions of the «authentic» but «reformable» magisterium of the popes of the 19th century regarding the issue of «freedom of conscience». The 1983 Code, in a certain sense, would make impossible today what was done between 1962 and 1965. The institutional demand for silence, for self-censorship, has increased rather than decreased, extending this obligation not only to the infallible magisterium, but to the entire ordinary magisterium. It is evident that, without spaces for effective and open debate, the development of a doctrine updated to the new established condition remains difficult.
